Terms and Conditions of Sale

 

Cinema

To the extent permitted by law, and without limiting the application of New Zealand Consumer Law and the Consumer Guarantees, the Organisation's liability to you in connection with the purchase or use of any products or services obtained from this Site is limited to either:
replacement of those products or services; or
a refund of the cost of purchase of those products and services.
Tickets purchased via this website are sold for a specific session only and are sold on a strict no-refund, no-exchange and no-transfer basis unless required by law. We will refund in full if a session does not go ahead due to a cinema fault, excepting force majeure or events outside of our control. If you are unable to make a show refunds are available at the physical box office only up to one hour before the show starts. Refunds and swaps are not available after the show has started. Refunds and swaps are not available over the phone or via email.

You acknowledge the Organisation's right to enforce film classification requirements set by the New Zealand Censorship Board and you will not purchase tickets that you (and any persons on whose behalf you purchase tickets) are not legally entitled to see, for instance if you are under 16 you cannot purchase and use tickets for a film classified R16. The Organisation reserves the right to insist that you provide suitable photographic identification depending on a film’s classification.

 

Returns and refunds

Goods or services purchased from this site for personal use are covered by the New Zealand Consumer Guarantees Act 1993 and may be returned, if they are considered faulty, for repair, replacement or refund of purchase price within a reasonable period of time as defined by the Act.

When you purchase goods or services from this site for business purposes then the guarantees and rights expressed or implied in the Consumer Guarantees Act 1993 in your favour do not apply to those goods or services.

Your satisfaction is our goal. We will exchange or refund product/s that are in a re-saleable condition, i.e. unopened and unused, but sorry, we are not able to exchange or refund products which have been used unless they are faulty (see policy below).

If your order arrives damaged or defective or if we have sent you the wrong product we will happily replace or refund the items.

We recommend that you return your package using signature required New Zealand Couriers. If you use general post your package will not be insured and we cannot accept liability if it is damaged or goes missing.

We can only refund postage costs where the return is a result of our error.
 

 

Cancellations

You may cancel an order by contacting our Customer Services staff during contact hours (Monday - Friday 9.30am – 5pm) at any time prior to the dispatch of that order.

Once the order has been dispatched for delivery, you may then return the relevant products in accordance with our Return and Refund Policy.

 

Delivery

NEW ZEALAND
We use New Zealand Couriers and DX Mail to deliver our items. Delivery is normally 2-5 business days nationwide, and 3-5 business days for our rural delivery customers.

We recommend that you give us an address where someone will be able to sign for the delivery. Deliveries normally occur between 8am and 5pm Monday to Friday. If no one is home, a card to call will be left with instructions on how to obtain your parcel.

We are happy to deliver to an office/business address, but make sure you give us the full address including the company name and level we need to deliver to.

We must have correct and complete addresses, including a company name where necessary, and at least one contact telephone number.

AUSTRALIA AND INTERNATIONAL SHIPPING
All orders are sold and delivered from New Zealand. Your purchase may require you to pay import duties and taxes - if so you will be charged once your parcel has reached your country of residence. Unfortunately, we have no control over these charges. If you have any questions related to customs charges you are advised to contact your local customs office.

Please provide us with a street address if you want your purchase to be couriered and tracked. If you provide us with a PO Box it will be sent by post and not be couriered and tracked.

Your Privacy

All information supplied by you to us will be used only for purposes directly related to your purchase and will be held in accordance with the Privacy Act 1993 and the Local Government Official Information and Meetings Act 1987. Your information will be kept confidential to us so far as permitted by law.

We collect and hold your personal information to supply you with the goods and services you have purchased from us, to obtain payment, to contact you in the event that there is a problem with filling your order. We will not otherwise use that information [for example, your personal information will not be provided to others for purposes other than as outlined, such as selling customer lists (unless required to do so by law)].

If you haven’t correctly provided your information to us we may not be able to deliver the goods and services to you properly, or provide you with a refund if we’ve decided to refund any money to you. We reserve the right to cancel your order if you supply us with incorrect information.

Under the Privacy Act 1993 you have rights to access and correct the personal information you provide to us.

We may update this Privacy Policy from time to time by placing an amended version of the policy on this website. Please check the website regularly for changes to this policy. Once the Privacy Policy is changed your ongoing use of this website indicates your acceptance of the changes.
